Stay Compliant with Compensation Rules

Canopy MLS has a “zero-tolerance” policy regarding any mention of compensation in any MLS field. ALL listings in the MLS in ALL PROPERTY CATEGORIES are prohibited from including an offer of compensation, which also includes references to payment of a bonus or referral fee. When closing out a listing, adding a statement such as “no compensation was paid” is also a violation. Adding “Contact me at ‘x’ for more information” is permitted in the Agent Remarks.

The most common compensation violations include:

  • Text that references compensation, commission, bonus, or referral fees in any MLS field. Terms such as BAC, NC Form 220, SC Form 120, co-broke, “seller will pay you” are also prohibited.
  • Including NC Form 220, SC Form 120 or any other compensation agreement in the attachments.
  • Text that directs agents to submit referral requests to a website or email.
  • Text that indicates that agents must show a property to be eligible for commission or referral fee.
  • Including a URL in any MLS field that contains a compensation-related term, such as abccompensates.com.
  • Using ShowingTime or other MLS tools to make offers of compensation.
  • Including a link to a website in any MLS field which, with a single click on the link, would immediately display an offer of compensation.
  • Text that indicates that buyer agents must pay a registration fee or tech fee for offer submission. The fee itself can be mentioned, but not who must pay the fee. This must be handled outside the MLS.
